Terms of Service

Introduction

  • By booking or participating in any tour, service, or package offered by D’Palawan Travel and Tours (“the Company”), you (“the customer”) acknowledge and agree to these Terms & Conditions.
  • The Company coordinates nature-based adventures in Palawan, particularly Balabac, and partners with various local service providers.
  • These areas can be remote, with limited infrastructure and unpredictable conditions, so careful reading of these Terms is essential before booking.

Core Philosophy of Responsible and Authentic Travel

  • The Company’s guiding principle is responsible, authentic tourism that respects local communities, preserves natural habitats, and sustains cultural traditions.
  • Emphasizes minimizing waste, respecting customs, supporting community economies, and advocating ecological preservation practices.
  • Participation implies a shared commitment to these values, ensuring both a transformative experience for travelers and positive contributions to the region.

Scope of Services

  • D’Palawan Travel and Tours’ primary focus is organizing tours in and around Palawan, with Balabac as a highlight.
  • The Company provides island-hopping, snorkeling, camping, cultural visits, and coordination for accommodations.
  • Partner Service Providers may handle specific components like transportation or lodging.
  • Services may be modified based on weather, local restrictions, or safety.
  • Because these regions are remote, modern conveniences may be limited, so early communication of special requests is advised.

Focus on Adventure Over Luxury

  • The tours emphasize real, nature-centric experiences rather than upscale comforts.
  • Accommodations and schedules often adapt to weather and local conditions, requiring flexibility.
  • This can mean unforeseen itinerary changes, basic lodging, or temporary disruptions.
  • Rather than viewing these as inconveniences, travelers are encouraged to embrace the natural rhythms of Palawan and discover hidden gems.

Basic Accommodations & Facilities

  • Expect simple huts, tents, or modest rooms prioritizing immersion in the environment over luxury.
  • Facilities usually feature bucket-flush toilets, limited electricity (often via generator), and minimal comforts.
  • Freshwater conservation is vital, and Wi-Fi or robust connectivity may be unavailable.
  • You may stay on the mainland (with slightly better amenities) or close to island attractions, but please align expectations with these realities.
  • Lodging focuses on proximity to nature, utilizing basic materials such as nipa roofs and bed foams. Air-conditioning or Wi-Fi may be absent, and open-air ventilation is common.
  • Modern plumbing is scarce, so bucket-flush toilets and pail-and-bucket showers are standard. Hot water is generally unavailable, and freshwater is conserved diligently. Expect possible waits during peak usage times.
  • Generators power most island locations only a few hours each evening. Guests should bring power banks and charge devices during available windows. Practice mindful consumption to reduce ecological strain on these fragile locations.
  • Choosing mainland lodgings entails longer commutes to main attractions; choosing island lodgings offers immediate access but basic conditions. Either way, the focus is on authentic engagement with nature and community.

Meals & Market Availability

  • Meals generally feature local staples: rice, fish or seafood, meat, vegetables, and fresh fruit if available.
  • Market supplies are limited, with ingredients sourced from remote locations like Brooke’s Point. Variability in availability may require last-minute adjustments or simpler meal options.
  • Most Balabac packages include basic meals—rice, seafood or fish, meat, vegetables, fruits (when possible), and mineral water. These reflect the region’s food culture and limited market offerings.
  • Supply disruptions are common due to the distance of the main market. Seasonal changes further affect meal components. The Company aims for balanced offerings but adapts as needed.
  • Provide at least one week’s notice if you have specific dietary requirements. The Company will try to accommodate requests (vegan, vegetarian, allergies), but you may need to bring additional items from Puerto Princesa.
  • Because local shops are sparse, you might bring your own snacks or drinks from Puerto Princesa. Please minimize packaging waste and observe responsible disposal methods.

Embracing the Natural Environment

  • Palawan’s weather can shift quickly, resulting in itinerary changes for safety. Expect insects, wildlife, and limited digital connectivity. Bring insect repellent, protective gear, and be ready for a largely offline experience.
  • Tropical climates can abruptly alter plans. Local guides and boat captains make real-time decisions to ensure safety when storms or rough seas arise. Flexibility is key.
  • Areas near beaches, mangroves, and forests host mosquitoes, sand fleas, ants, and larger animals. Use repellent, wear protective clothing, and avoid feeding wildlife.
  • Wi-Fi, mobile data, and phone signals may be absent. This encourages deeper engagement with the surroundings and local culture, offering a break from digital routines.

Transportation Details

  • Van transfers between Puerto Princesa and Buliluyan may be arranged through Partner Service Providers, with possible road delays. Boat rides are integral but governed by weather and sea conditions. Travelers should prepare for potential motion sickness and use waterproof bags.
  • Van services only pick up within Puerto Princesa’s city center (town proper). External factors like traffic or poor roads can cause schedule changes, and communication along rural routes may be limited.
  • Island-hopping relies on local captains who may cancel or modify departures for safety. Secure valuables in waterproof containers, and be prepared for unpredictable waves.

Financial Details

  • Balabac lacks ATMs. Bring sufficient cash in smaller bills. Payment options include cash or electronic transfers (with related fees). Full payment is required before departure. No payment means no tour, and non-payment can result in legal remedies.
  • Withdraw enough money in Puerto Princesa for personal needs and tips. Vendors often cannot make change for large bills.
  • Cash is preferred; electronic methods are available for initial bookings, but the balance is settled in cash. Transaction fees are the customer’s responsibility.
  • All logistics demand upfront payment for local suppliers. Full payment must be settled before leaving Puerto Princesa’s business district.
  • On-the-spot upgrades (e.g., from tent to hut) are treated as new transactions. The prior payment is forfeited, and the upgraded service requires full payment.
  • Any add-ons require immediate full payment; no tabs or deferred settlements are permitted.
  • Failure to pay can lead to legal action, blacklisting, and notification of embassies, airports, or immigration authorities. This policy protects local providers and prevents fraudulent activities.
  • The Company has standardized rates for regular Balabac packages. Customized or last-minute requests may incur higher costs due to local availability and additional coordination efforts.
  • Plan your budget carefully to cover tips, personal expenses, and unforeseen costs. Showing readiness supports local communities reliant on daily tourism income.

Cancellation & Change Policy

  • If you wish to cancel your tour or make some changes to your booking, please notify us through email at least 8 days before the scheduled date of your travel/tour for a possible refund or free rescheduling.
  • Cancellations or major changes within seven days are non-refundable which means will result to the forfeiture of your payment or the reservation fee.
  • Please note that funds allocated to suppliers cannot be recouped once disbursed. No refunds for partial use of the package inclusions or in case of non availment of any or all of the package inclusions. Book at least three days ahead to allow smoother coordination with local suppliers and service providers in Balabac.
  • All payments are non-refundable if you cancel or significantly alter your booking less than seven days before the tour.
  • Once supplier payments are sent, refunds are not possible, even for partially consumed services or mid-trip changes.
  • Transaction-related fees are non-refundable under all circumstances, including any service-related refunds.
  • Post-booking alterations, such as adjusting lodging or the number of guests, entail new costs. Thorough planning helps avoid unexpected expenses.
  • D’Palawan Travel and Tours requires a three-day advance booking to align with limited connectivity in Balabac. Rush bookings are non-refundable and prone to logistical lapses.

Communication & Documentation

  • All official communications, including confirmations, requests, or modifications, must be documented in writing via email or recognized messaging platforms. Verbal agreements are not binding unless confirmed in writing. This reduces misunderstandings and creates verifiable records, especially in areas with poor connectivity.

Personal Responsibility & Liability Limits

  • The Company’s maximum liability, if found at fault by a competent authority, is limited to the amount paid by the customer for the specific tour or service. The Company is not liable for indirect or consequential damages. Travelers assume responsibility for following safety rules, securing personal belongings, and acquiring relevant insurance. Partner Service Providers operate independently; their errors or mishaps fall outside direct control, though the Company strives to assist with resolutions.
  • Follow instructions from staff and Partner Service Providers, use gear responsibly, and safeguard personal items. Acquire appropriate insurance coverage.
  • Partner Service Providers are independent; mechanical failures or scheduling conflicts are their responsibility, though the Company will mediate if needed.
  • Remote travel involves inherent risks, including limited medical facilities. Comprehensive travel insurance is strongly recommended.
  • Weather, community restrictions, and other variables can force itinerary changes. The Company prioritizes safety and appreciates flexibility. Adjustments can lead to unique and rewarding spontaneous experiences, forming some of the trip’s most memorable moments.

Acceptance of Terms & Conditions

  • Regardless of your payment status, booking or using any Company services confirms your understanding and acceptance of these Terms & Conditions, as well as additional policies (Disclaimer, Disclosure, Privacy Policy, Refund Policy). Do not book if you are uncomfortable with limited signals, basic facilities, or nature-dependent schedules. Payment indicates consent to these realities.

Feedback, Satisfaction & Cooperation

  • If you encounter service issues (cleanliness, meal quality, etc.), submit documented feedback (email, messaging apps) with photos or videos if possible. The Company uses this data to investigate and improve.
  • If problems arise mid-tour (e.g., boat breakdowns, guide misunderstandings), document them promptly in writing. Delays in connectivity can impede real-time resolutions, and complaints received after the trip may not be resolved immediately.
  • Balabac tours often involve diverse travelers with varying comfort levels. Cooperation and open communication enhance group harmony. Disruptive or scandalous behavior can lead to tour termination at the Company’s sole discretion.

Scope of Service & No Guarantees (continued)

  • Nature is unpredictable; wildlife encounters and ideal weather cannot be assured. Completed services are deemed consumed, even if they did not match personal expectations. In rare cases of severe disruption, the Company attempts to reschedule or substitute activities but typically does not issue refunds for weather or force majeure.
  • D’Palawan Travel and Tours endeavors to maximize sightings of marine life and schedules activities in favorable conditions but cannot guarantee their presence or perfect weather.
  • No refunds for used services or partially visited destinations. Revenue supports local communities reliant on day-to-day tourism income.
  • In exceptional cases where the main activity is canceled for safety, the Company will try to provide an alternative of similar value. Weather-related disruptions typically do not qualify for refunds.

Final Acknowledgment & Preparedness

  • The Company’s small-scale focus on Balabac and Palawan means limited staff and communication. Read online feedback for personal insights, but each trip is unique and subject to environmental changes.
  • Prepare with essentials like bug spray, medications, sunscreen, sun hats, comfortable footwear, and waterproof bags.
  • Embrace flexibility, respect local culture, and understand that these Terms aim to protect both travelers and communities.

Dispute Resolution Clause

  • Disagreements shall first be handled through amicable negotiation. If unresolved, mediation or arbitration follows.
  • Philippine law governs any legal actions, which must be filed in the Philippines. By accepting these Terms, you agree to this exclusive jurisdiction.

Joiners Type Package Tour

  • Open to solo travelers, couples, barkadas, and teambuilding groups.
  • Exclusive group tours are available upon request and subject to a custom quotation.

Payment

  • A P2,000/person reservation fee is required to confirm your booking.
  • Reservation fees are not refundable but transferrable.
  • It is the guest’s responsibility to get a replacement in case they are unable to attend or join.
  • A screenshot of the down payment must be sent for verification.
  • PayPal transfer fees will be shouldered by the guest.
  • The remaining balance must be paid in full at least 1 week before the tour date to avoid cancellations or forfeiture.

No-Show/Backout Policy

  • If the guest cancels or does not show up 1 week or less before the tour (including 3 days prior), both the down payment and the full balance will be forfeited.

Force Majeure Policy

  • In the event of natural calamities, bad weather conditions, or cancellations mandated by the local government, full refunds or partial refunds will be issued for tours or services not completed.

Child Rates

  • Children 0-4 years old are free of charge.
  • Children 5-6 years old are charged at half rate.
  • Children 7 years old and above are charged at the regular adult rate.

Liability Disclaimer

  • The owner or travel agency is not liable for any loss or damage to the personal belongings of guests.

Rebooking

  • If the Guest wishes to rebook their confirmed trip to another schedule, they must inform the Host at least 14 days before the trip.
  • Rebooking is only allowed once. Another request will not be considered, and the down payment will be forfeited.

Refunds

  • No refunds will be issued if the Guest decides not to go, even if the Coast Guard permits sea travel.

Liability

  • The Host is not responsible for loss, damage, injury, or theft of personal belongings.
  • Guests are advised to secure their valuables at all times.

Agreement

  • By paying the required reservation fee/deposit, the Guest acknowledges and agrees to abide by these terms, including all the other applicable provisions posted at D’Palawan Travel and Tours Terms of Service.
  • Proceed with booking only if you agree to these terms.

Cancellation by the Host

  • In case of severe weather warnings or if the Coast Guard cancels tourist boat activities:
    • Before the Scheduled Trip:
      1. Rebook to the next available tour date (if it still fits their schedule).
      2. Cancel & receive a refund, deducting ₱2,000 per person down payment.
      3. Change Tour Destination (El Nido, Puerto Princesa, or Port Barton). The excess deposit from the Balabac tour will be applied accordingly.
    • While Already in the Campsite:
      • If guests are already in Balabac and island tours are prevented by the Coast Guard, refunds will be given only for unused services (accommodation, meals, island entrance fees) based on our contracted rates with suppliers/providers.

Force Majeure Policy

  • The Host is not liable for delays, cancellations, or changes due to natural disasters, acts of God, government actions, or other unforeseen events.
